Defense attorney charged with criminal gang activity

ATLANTA, GA – A defense attorney known for her vigorous representation in gang-related cases is now facing criminal charges herself. Nicole Fagan has been indicted on multiple charges, including allegations of tipping off a fugitive about evidence disposal.

The charges against Fagan have sent ripples through the legal community. Her attorney, Drew Finling, expressed strong disapproval of the indictment, describing it as a “travesty.” He emphasized Fagan’s reputation as a respected trial attorney and dismissed the charges as unfounded. According to Finling, the allegations date back more than two years, during which Fagan was actively defending her client in the YSL gang trial.

Fagan, a prominent figure in local legal circles, is recognized for her effective defense of clients accused under Georgia’s Street Gang Terrorism and Prevention Act. JP Miller, a former gang investigator and current private investigator, attested to her reputation, noting her history of securing favorable outcomes for her clients.

The indictment accuses Fagan of violating the Street Gang Terrorism and Prevention Act and other charges. It alleges she unlawfully solicited a fugitive involved in a gang-related murder case to tamper with evidence. Further charges suggest she urged the fugitive, a member of the 4PF gang, to dispose of his phone to hinder an ongoing prosecution.

Additional allegations include Fagan and a co-defendant unlawfully providing prohibited items to an inmate, Tenquarius Mender, at the Fulton County Jail. These items reportedly included methamphetamine, oxycodone, and marijuana.

Miller, who has worked with Fagan on various cases, expressed surprise at the charges, describing her as a professional colleague. Court documents reveal that Fagan was Mender’s defense attorney, and he recently entered guilty pleas to several charges, including possession of a weapon and telecommunications device while incarcerated, as well as participation in criminal street gang activities.

The complexity of the case continues to unfold as legal teams prepare to address the charges. Fagan’s supporters remain confident in her innocence, while the legal community closely watches the developments.
