Police say an argument involving a father and son at a sports bar continued at a home before the father was fatally shot.
FORT WORTH, TX — A 24-year-old man has been charged with murder after authorities say an argument involving his father at a Fort Worth sports bar continued at a residence, where the father was fatally shot early Saturday.
Fort Worth police responded about 3:36 a.m. Sept. 26 to a shooting call in the 8300 block of North Riverside Drive. Officers found 41-year-old Nicacio Hernandez III at the scene, and he was pronounced dead. Johnathan Hernandez, identified in an arrest affidavit as the victim’s son, was detained at the property and later charged with murder. Police have described the shooting as an isolated incident involving people who knew each other.
According to an arrest affidavit obtained by FOX 4, the events leading to the shooting began the previous night when Johnathan Hernandez met his father and mother at a BoomerJack’s restaurant in Lake Worth. They later went to Tumbleweeds Sports Bar in Fort Worth, where Hernandez became involved in a verbal disagreement with one of his father’s friends. The affidavit says Hernandez became angry after his father sided with the friend during the dispute.
The disagreement continued after the family returned home, according to the affidavit. Hernandez told investigators that he and his father argued about what had happened at the bar and that he struck his father several times because he believed his father was about to hit him. Hernandez also told police that his father then produced a knife, prompting him to run from the property. He said he heard a gunshot while leaving and believed his father had fired toward him. Those statements are Hernandez’s account to investigators and have not been established as findings in court.
The affidavit says Hernandez then obtained a ride to his apartment, retrieved a rifle-style firearm from his vehicle and returned to his father’s residence. Hernandez told investigators that after he came back, he believed his father posed a danger to relatives at the home. Police allege Hernandez then shot his father multiple times. Family members interviewed by investigators said they did not believe Nicacio Hernandez posed an immediate threat to them, according to the affidavit.
Fort Worth police Public Information Officer Tracy Carter told FOX 4 that investigators also learned Hernandez had spoken to his girlfriend before returning to the residence. Carter said Hernandez told his girlfriend that he was going to do something to his father, and the girlfriend made a call to the residence. Police have said the investigation remains ongoing, and the affidavit represents allegations and evidence collected during the early stages of the criminal case.
Initial reporting from NBC 5 Dallas-Fort Worth said Hernandez was at the scene when officers arrived and surrendered with his hands raised. Police initially said the two men knew each other and that investigators believed the shooting was an isolated incident. The later affidavit provided additional details about their father-son relationship and the argument authorities say preceded the shooting.
Hernandez was being held in the Tarrant County Jail on a $500,000 bond, according to FOX 4’s report Monday. He faces a murder charge. A criminal charge is an allegation, and Hernandez has not been convicted. Authorities have not publicly announced additional charges, and police said some circumstances surrounding the confrontation remain under investigation.
