Authorities arrested Jeremy Porter less than a day after 5-year-old Zah’Layah Walter was fatally shot inside her mother’s vehicle.
HARRIS COUNTY, TX — A 47-year-old Cypress man has been charged with capital murder in the shooting death of a 5-year-old girl who was riding with her mother and four siblings on a northwest Harris County roadway, authorities said.
Jeremy Porter was arrested Sunday and booked into the Harris County Jail in connection with the death of Zah’Layah Walter, Harris County Sheriff Ed Gonzalez said. The shooting happened late Saturday, Sept. 19, on Grant Road near Jones Road. Investigators initially described the shooting as apparently related to road rage, though Zah’Layah’s mother has disputed that characterization and said she had no confrontation with another driver before the gunfire.
The Harris County Sheriff’s Office said the family was traveling west on Grant Road around 11:30 p.m. when someone opened fire on the vehicle. Monica Hicks was driving with five children, all younger than 10, inside. Zah’Layah was struck by gunfire, while two other children suffered minor injuries from shattered glass. Hicks was not injured.
Zah’Layah was taken by helicopter to Memorial Hermann Hospital, where she was pronounced dead. Hicks told local reporters that she initially heard a noise and then heard her children screaming. She said she stopped and began checking on the children before realizing her youngest daughter had been shot. Emergency crews responded and tried to save the girl before she was flown to the hospital.
Authorities said automated license plate reader technology helped detectives identify a vehicle connected to the investigation. Court records cited by the Houston Chronicle say investigators tracked a white Ford pickup truck to a home and located Porter. Gonzalez credited the technology with helping investigators quickly develop information that led to the arrest.
According to court records reported by the Chronicle, Porter told investigators he was driving the truck and fired five rounds at the family’s vehicle. The records say he told officers he believed the other vehicle had fired at him and was being driven erratically. Investigators found four apparent bullet strikes on the family’s vehicle, according to the court records. Authorities have not announced evidence showing that anyone in Hicks’ vehicle fired a weapon.
Hicks has said she did not exchange words with the other driver, sound her horn or cut another vehicle off before the shooting. Her account leaves a key part of the case unresolved as detectives continue examining what happened immediately before the shots were fired. The sheriff’s office has continued to describe the case as an apparent roadway or road-rage shooting while the investigation remains active.
Porter remained in the Harris County Jail on Monday after a probable cause hearing, according to county records reported by the Chronicle. He was expected to appear Tuesday in the 338th District Court. Prosecutors have filed a motion seeking to deny bail, though a hearing on that request had not been scheduled as of Monday morning. A public defender was listed as representing Porter.
The capital murder charge is an accusation and does not establish guilt. Porter is presumed innocent unless convicted in court. Investigators have not publicly announced a final determination about what prompted the shooting, and additional evidence could emerge as the criminal case moves through court.
