Man Killed in Shooting Tied to Alleged Affair

Police detained a man after the shooting outside a Buford Highway restaurant, where two bystanders were also hurt by shattered glass.

DORAVILLE, GA — A man was fatally shot outside a restaurant on Buford Highway early Sunday, and police detained another man who investigators said linked the confrontation to an alleged affair.

Doraville police identified the man who died as Pablo Gutierrez-Gallegos and the man taken into custody as Daniel Roman-Cortez. Officers responded around midnight Oct. 25 to reports of gunfire in the 5700 block of Buford Highway, near Interstate 285. The shooting also sent glass fragments into a restaurant, injuring two people seated inside, police said.

Responding officers saw a blue pickup truck attempting to leave the area and conducted a traffic stop, according to police. Investigators said Roman-Cortez surrendered during the stop and told officers he had shot and killed the other man. Police took him into custody while other officers continued searching the area.

Officers later found Gutierrez-Gallegos unresponsive on the pavement outside a restaurant in the 5800 block of Buford Highway. Police attempted lifesaving measures before DeKalb County paramedics arrived. Gutierrez-Gallegos was pronounced dead at the scene.

Police said gunfire also struck the restaurant and shattered glass near people seated inside. Two patrons were hurt by glass fragments. Emergency medical personnel evaluated them at the scene, and authorities said their injuries were not considered serious.

Investigators described the shooting as the result of a personal dispute. According to police, Roman-Cortez told investigators that he believed Gutierrez-Gallegos was involved in an affair with his wife. Authorities have not independently established that allegation, and police have not released additional evidence about the claimed relationship.

Doraville Police Chief Deyette said the department was committed to a thorough investigation and to pursuing justice for Gutierrez-Gallegos and his family. The Georgia Bureau of Investigation is assisting Doraville police as investigators process evidence connected to the shooting.

Authorities had not publicly identified the restaurant in the reports reviewed Monday, and formal charges against Roman-Cortez had not been confirmed by Doraville police in those reports. Roman-Cortez remained in police custody as the investigation continued.

Police have asked witnesses and others with information about the shooting to contact the Doraville Police Department. Investigators have not announced additional arrests or released further details about what happened immediately before the gunfire.
